BarterBloom Terms of Service

Welcome to BarterBloom. These Terms of Service govern your access to and use of the BarterBloom website, applications, services, and marketplace features. By creating an account or using BarterBloom, you agree to these Terms. If you do not agree, do not create an account or use the service.
Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use BarterBloom. You may not use the service if your account has previously been suspended or terminated unless BarterBloom gives you permission.
Marketplace role
BarterBloom provides a marketplace platform that connects users who wish to offer, request, exchange, buy, sell, or barter goods or services. BarterBloom is not the buyer, seller, owner, broker, agent, guarantor, or insurer of items or services offered by users. Users are responsible for evaluating each other, inspecting items, determining value, and deciding whether to complete a transaction.
Taxes resulting from trades
Any tax liability, reporting requirement, filing obligation, or payment obligation that results from a trade, barter, exchange, sale, or other transaction between users is the responsibility of the users involved in that transaction.
BarterBloom is a marketplace platform that connects users and is not responsible for determining, calculating, collecting, reporting, or paying taxes that arise from a user's trade, except where BarterBloom is specifically required to do so by applicable law. BarterBloom does not provide tax advice.
No guarantee of value or condition
Estimated values, descriptions, photos, categories, condition statements, and other listing information are provided by users. BarterBloom does not independently verify or guarantee the accuracy, authenticity, legality, ownership, quality, safety, condition, or value of any listing.
User responsibilities
You agree that information you provide will be accurate and that you have the legal right to offer anything you list. You are responsible for your account activity and for protecting your login credentials.
Prohibited listings and conduct
You may not use BarterBloom to offer, request, promote, or exchange illegal goods or services, stolen property, prohibited regulated items, controlled substances, counterfeit goods, fraudulent services, sexually exploitative material, dangerous goods, or anything that violates applicable law or another person's rights. Fraud, harassment, threats, impersonation, spam, manipulation, account abuse, and attempts to bypass platform security are prohibited.
Trades and meetups
Users decide whether, when, and where to meet or complete a transaction and are responsible for taking reasonable safety precautions. BarterBloom cannot guarantee the identity, intentions, conduct, or safety of another user.
No obligation to complete a proposed trade
Unless applicable law requires otherwise, an offer, counteroffer, acceptance, or meetup arrangement made through the platform does not make BarterBloom a party to the transaction. Users remain responsible for their own agreements and obligations to one another.
Disputes between users
BarterBloom may provide reporting, moderation, review, or account-action tools but is not required to resolve private disputes between users. We may investigate reports and may restrict, suspend, or terminate accounts where appropriate.
Reviews and user content
You retain ownership of content you submit. You grant BarterBloom a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and use that content as necessary to operate, secure, promote, and improve the service. Reviews must reflect genuine experiences and may not be fraudulent, abusive, defamatory, or manipulative.
Account suspension and termination
We may restrict, suspend, or terminate access where we reasonably believe a user has violated these Terms, created risk for users or the platform, engaged in fraud or abuse, or where action is necessary to comply with law or protect the service.
Service availability
We may modify, suspend, or discontinue features. We do not guarantee uninterrupted or error-free operation.
Disclaimer of warranties
To the fullest extent permitted by law, BarterBloom is provided “as is” and “as available.” We disclaim warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranty concerning the accuracy, safety, condition, legality, or value of user listings.
Limitation of liability
To the fullest extent permitted by law, BarterBloom and its owners, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the platform, interactions between users, lost or damaged property, personal injury caused by another user, lost profits, or loss of data. Nothing in these Terms excludes liability that cannot legally be excluded.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless BarterBloom and its owners, employees, contractors, and affiliates from claims arising from your listings, conduct, trades, content, violation of these Terms, or violation of another person's rights.
Changes to these Terms
We may update these Terms. If changes are material, we will provide reasonable notice where required. Continued use after the effective date of revised Terms constitutes acceptance where permitted by law.
Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.
